1. Scope
These General Terms and Conditions (GTC) of Riviera Diamonds Limited apply to all contracts for the sale of goods that a consumer or entrepreneur concludes with us via our online shop.

1.2 Consumer Definition
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or professional activities.
1.3 Entrepreneur Definition
An entrepreneur is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, does so in the course of their commercial or professional activity.
2. Conclusion of Contract
Our product descriptions are not binding offers but invitations for you to make a binding offer.
2.2 Order Process
You submit a binding offer by completing the checkout process and clicking the final order button.
2.3 Acceptance
We may accept your offer within five days by:
- Sending an order confirmation
- Shipping the goods
- Requesting payment
If none occurs within five days, your offer is considered rejected.
PayPal Orders
For PayPal payments, the contract is concluded immediately when you click the final order button.
3. Right of Withdrawal
As a consumer, you generally have a statutory right of withdrawal.
4. Prices and Payment Terms
All prices shown are total prices including statutory VAT unless stated otherwise. Additional delivery costs are shown separately.
4.2 Payment Methods
We accept various payment methods as displayed during checkout.
4.3 Prepayment
If prepayment via bank transfer is agreed, payment is due immediately after contract conclusion.
5. Delivery and Shipping Conditions
We deliver to the address you provide during checkout. For PayPal payments, we use the address registered with your PayPal account.
Delivery Failure
If delivery fails due to your fault, you may be responsible for reasonable costs incurred, except when exercising your right of withdrawal.
5.3 Risk Transfer
For businesses: Risk transfers when we hand goods to the carrier.
For consumers: Risk transfers when you or your representative receive the goods.
5.4 Delivery Issues
We may withdraw from contract if correct delivery isn't possible through no fault of ours. In such cases, we'll refund any payments immediately.
5.5 Collection
Self-collection is not available for logistical reasons.
6. Retention of Title
If we provide goods in advance, we retain ownership until full payment is received.
7. Liability for Defects (Warranty)
Unless stated otherwise, statutory warranty provisions apply.
For Businesses
- We choose the defect remedy method
- 1-year warranty for new goods
- No warranty for used goods
7.3 Consumers & Used Goods
For used goods purchased by consumers, warranty is limited to 1 year if:
- This was expressly agreed
- You were specifically informed before ordering
7.4 Exceptions
Limitations don't apply to:
- Damage claims
- Fraudulently concealed defects
- Building materials causing building defects
- Update obligations for digital products
8. Special Conditions for Custom Products
For custom products, you must provide all necessary content and confirm you have rights to use it.
8.2 Indemnification
You agree to protect us from third-party claims regarding content you provide, unless you're not responsible.
8.3 Content Restrictions
We may reject orders containing illegal or offensive content.
Important Note
Custom products cannot be returned or exchanged.
9. Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this applies only if it doesn't deprive you of mandatory protections under your country's laws.
10. Place of Jurisdiction
For business customers in Germany, our registered office is the exclusive jurisdiction. For those outside Germany, we may also take legal action in your jurisdiction.

The EU provides an online dispute resolution platform for consumers.
